1. Payment is due within 5 (five) business days of auction closure.

2. Any invoice $5,000 or above requires payment via wire transfer.

When applicable, sales tax is calculated based upon the auction’s advertised location.

If you are seeking sales tax exemption, you must complete Liquidity Services’ tax exemption form(s). We recommend doing this prior to the auction’s closure or before making payment. To do so, please visit Liquidity Services' Tax Exemption Submission Tool.

Property may be removed by appointment only and appointments must be made at least 24 hours in advance.
Monday through Thursday, 8:00 am – 3:00 pm – excluding all holidays and scheduled school closings.

All items must be removed within ten (10) business days from the time and date of issuance of the Buyer's Certificate.

The Buyer will make all arrangements and perform all work necessary, including packing, loading and transportation of the property. No Assistance will be provided. A daily storage fee of $10.00 may be charged for any item not removed within the 10 business days allowed and stated on the Buyer's Certificate.

If using a Third Party Agent; Buyer must provide agent with a faxed copy including their signed authorization to release their items. Buyer must notify Seller if using a Third Party Agent.

Items are sold in lots; bidder must pick up all items in lot. Bidder will not be allowed to choose items from lots with a promise to return for remaining lot items. Failure to retrieve all items purchased in a lot will result in notification to GovDeals of bidder’s default.

Buyer must sign a Bristol Virginia Public Schools Employee Disclosure form before removing items.

NOTICE: If you are the winning bidder and default by failing to adhere to this sellers terms and conditions your account with Liquidity Services WILL BE LOCKED.

Guaranty Waiver. All property is offered for sale 'AS IS, WHERE IS.' Bristol Virginia Public Schools makes no warranty, guaranty or representation of any kind, expressed or implied, as to the merchantability or fitness for any purpose of the property offered for sale. Please note that upon removal of the property, all sales are final.

Description Warranty. Seller warrants to the Buyer that the property offered for sale will conform to its description. Any claim for misdescription must be made prior to removal of the property. If Seller confirms that the property does not conform to the description, Seller will keep the property and refund any money paid. The liability of the seller shall not exceed the actual purchase price of the property.

Personal and Property Risk: Persons attending during exhibition, sale or removal of goods assume all risks of damage of or loss to person and property and specifically release the seller and GovDeals from liability therefore.

INDEMNIFICATION: The Buyer shall indemnify, save and hold harmless Bristol Virginia Public Schools (BVPS), its officers, agents, employees and volunteers against and from any and all injuries, death, loss, damage, claims, patent claims, suits, liabilities, judgments, costs of investigation, attorney fees, cost of appeals arising out of any such claims or suits, and other expenses which may otherwise accrue against BVPS in consequence of the purchase and removal of the item(s) or which may or otherwise result in connection with work therefrom, if it shall be determined that the act was caused through negligence, omission or commission of the Buyer, including its agents, subcontractors, employees, and volunteers. The Buyer expressly understands and agrees that any insurance shall in no way limit the responsibility to indemnify, keep and save harmless and defend BVPS as herein provided.

Buyer must sign a Bristol Virginia Public Schools Employee Disclosure form before removing items. Per Bristol Virginia School Board Policy File:DN The bidder or purchaser shall certify whether he/she is an officer or employee of the division or a member of the immediate family of an officer or employee. Officers and employees of the school division, and members of their immediate family, may purchase surplus property from the school division only if the property is being sold at uniform prices available to the public or if the goods are sold for less than $500.00.
