Buyer will not be able to confirm working condition as all utilities and plumbing have been disconnected. Moving this building from listed location will require road permits and buyers are encouraged to solicit quotes from a licensed building mover to inspect destination site prior to bidding. The Building is located at Painted Sky Elementary School, 8101 Gavin Road NW, Albuquerque, NM, 87120. All buildings are in "As Is" condition and should be inspected prior to submitting a bid. A VIEWING OF THIS PORTBLE HAS BEEN SCHEDULED FOR: THURSDAY, DECEMBER 12, 2019, FROM 8:30 AM – 12 NOON.

The purchaser shall remove the property at his expense within the period of time allowed in the invitation. Buyer is solely responsible to provide any personnel, equipment or material needed to pick up purchases and shall assume all responsibility for the removal of any item of property purchased at the sale and any and all risks associated with such removal including, without limitations, the responsibility for providing LICENSED AND BONDED professionals to ensure proper removal and loading, and full responsibility for any damage or liability to persons or property resulting from any negligent act or omission of Buyer or Buyer’s employees, agents and/or representatives during pick-up and removal. Seller will give Buyer 30 calendar days from the auction closing date to move the portable building off Seller's site and is subject to receiving full payment for the bid amount. TAX EXEMPTION: Where taxes are applicable (see the Buyer's Certificate), Tax Exempt documents must be provided to this seller within 24 hours of the auctions close and before payment is made. The purchaser shall be entitled to obtain the property upon full payment therefore with delivery being made only from the exact place where the property is located within the installation.

Property may be removed by appointment only and appointments must be made at least 24 hours in advance. All items must be removed within twenty (30) calendar days from the time and date of payment.

The Buyer will make all arrangements and perform all work necessary, including permits, packing, loading and transportation of the property. No Assistance will be provided. Buyer assumes all risk with such removal including without limitation the responsibility for providing licensed and bonded professionals for loading and removal and full responsibility for any damage or liability to persons and property resulting from any negligent act or omission of buyer, buyer's employees, agents or representatives during pick-up and removal. A daily storage fee of $10.00 may be charged for any item not removed within the 30 calendar days allowed and stated on the Buyer's Certificate.

All property must be paid for and picked up in the time frames of the offer. If not, the merchandise will be deemed abandoned and Buyer will lose any right, title or interest Buyer may have acquired and the merchandise shall revert and repossess to the Seller without further notice to Buyer and Buyer’s deposit will be forfeited. No purchaser may assign, transfer, or dispose of his rights in any article purchased before he has paid the purchase price in full. No reselling will be allowed from the premises.

SPECIAL CONSIGNOR REQUIREMENTS The Purchaser will make all arrangements and perform all work necessary to effect removal of the property. The Purchaser shall remove the property at his/her expense within 30 days payment made. If APS determines that the failure to remove the property within the period of time originally allowed arose out of causes beyond the control and without the fault or negligence of the Purchaser, such determination shall be reduced to writing, and a reasonable extension of time for removal shall be allowed. Such causes may include, but are not restricted to, acts of God or of the public enemy, acts of APS in its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, freight embargoes, and severe weather. If the Purchaser is permitted to remove the property after the expiration of the time originally allowed for removal or any additional time allowed by APS pursuant to this clause, APS, without limiting any other rights which it may have, may require the Purchaser to pay a reasonable storage charge. Items purchased under the Invitation will be released only to the Purchaser or his/her authorized representative. The authorized representative must furnish authorization from the Purchaser to the Custodian of the property location before any delivery of release will be made. The Purchaser shall reimburse APS for any damage to APS property caused during the removal operations by the Purchaser or his/her authorized representative.

NOTICE: If you are the winning bidder and default by failing to adhere to this sellers terms and conditions your account with GovDeals WILL BE LOCKED. Guaranty Waiver. All property is offered for sale 'AS IS, WHERE IS.' Albuquerque Public Schools, NM makes no warranty, guaranty or representation of any kind, expressed or implied, as to the merchantability or fitness for any purpose of the property offered for sale. Please note that upon removal of the property, all sales are final.

Description Warranty. Seller warrants to the Buyer that the property offered for sale will conform to its description. Any claim for imprecise description must be made prior to removal of the property. If Seller confirms that the property does not conform to the description, Seller will keep the property and refund any money paid. The liability of the seller shall not exceed the actual purchase price of the property.

REMEDIES: If any applicable conditions are not complied with by Buyer, then, in addition to any other remedies available to Seller, including and without limitation, the right to hold Buyer liable for the total purchase price, Seller may, at its option, (a) cancel the sale, retaining all payments made by Buyer, including any deposit made, as liquidated damages and/or (b) resell the merchandise at public auction in which event Buyer will be liable for the cost of removing and reselling the abandoned merchandise, for any deficiency between Buyer’s original purchase price and subsequent resale price, GovDeals commission, interest rates (a minimum of 1.5% per month or 18% per annum), legal fees, moving and storage (a minimum of $ 2.00 per square foot per month) and all other expenses related to the disposal or reselling of the abandoned property. In addition, Auctioneer may retain any merchandise purchased at auction by a defaulting Buyer as collateral security for Buyer’s obligations to Auctioneer.

RISKS: All risk loss shall pass to Buyer at the time of payment. If Seller is unable to deliver an article sold to Buyer due to fire, theft, or any other reasons whatsoever, GovDeals shall reimburse Buyer for all monies paid in respect to the article and Seller shall have no further liability to the purchaser arising from or relating to such loss, including without limitation any damages for loss of profits.
