All assets must be removed within ten (10) business days from the time and date of issuance of the Buyer’s Certificate. Purchases will be released only upon receipt of payment as specified. Buyers are required to complete and submit the Surplus Equipment Auction Affidavit. The Surplus Equipment Public Auction Affidavit is in PDF format, and can be found in the attachment section of the specific auction (below the online auction pictures) or by Clicking Here. The completed affidavit and payments are to be mailed (express mail preferred) to the Department of Procurement Services, 121 North LaSalle Street, Room 806, Chicago, Illinois 60602, Attn: Steve Loboda. Successful bidders are responsible for loading and removal of any and all property awarded to them from the place where the property is located as indicated on the website and in the Buyer’s Certificate. The Buyer will make all arrangements and perform all work necessary, including dismantling, packing, loading and transportation of the property. Under no circumstances will the City of Chicago assume responsibility for dismantling, packing, loading or shipping, unless specifically stated on the auction. Should the bidder use a third party to remove the purchased item, bidder must ensure that the third party has a copy of the “winning bidder documentation” or Bill of Sale and written authorization for the third party to remove the purchased item. See the instructions on each asset page for removal details. A daily storage fee of $25.00 may be charged for any item not removed within the ten (10) business days allowed and stated on the Buyer’s Certificate. The City of Chicago is not responsible for any theft or damage to the vehicles/equipment after the 10 business day time limit for payment and removal expires. Removal of certain equipment/materials may require the successful bidder to execute a Right of Entry (ROE) agreement and provide applicable license(s) and proof of insurance. The Right of Entry (where applicable) can be found in the attachment section of the specific auction (below the online auction pictures).

The City may remove the item to another location and bidder will be responsible for the costs incurred by the City of Chicago to dismantle, transport and store the item. In such an event, the City of Chicago shall not be responsible for any item damaged by such removal and, if the bidder has not made arrangements to pick up the item within thirty (30) calendar days and pay any and all applicable storage fees, the bidder shall be deemed to have ceded ownership to the City of Chicago. Thereafter, and the City of Chicago may dispose of the item as the City of Chicago deems reasonable and retain any proceeds therefrom.

There are no refunds or exchanges. All property is offered “As Is, Where Is”. The City of Chicago reserves the right to reject any and/or all bids considered, if the public interest may be served thereby. The City of Chicago also reserves the right to withdraw an item at any time - including during the bidding process.

ITEMS ARE BEING SOLD "AS IS", WITH NO WARRANTY, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. The Buyer is not entitled to any payment for loss of profit or any other money damages – special, direct, indirect or consequential. All sale are final.

The City of Chicago reserves the right to reject any and all bids and to withdraw from sale any of the assets listed.

City of Chicago employees and their relatives will not be permitted to bid. Buyer must be of legal age to enter into a contract with the City of Chicago. Vendors and individuals that have been debarred from doing business with the City of Chicago are not permitted to participate in these auctions.

By submitting a bid, the bidder agrees they have read, fully understand and accept these Terms and Conditions, and agree to pay for and remove the property, by the dates and times specified. Special Instructions appearing on the asset page will override certain sections of the terms and conditions.
