Property may be removed by appointment only and appointments must be made at least 24 hours in advance. All items must be removed within ten (10) business days from the time and date of issuance of the Buyer's Certificate. (CONTAINERS NOT INCLUDED) Buyer must bring their own container to transport shells.

The Buyer will make all arrangements and perform all work necessary, including packing, loading and transportation of the property. Buyer must bring own containers. No Assistance will be provided. A daily storage fee of $10.00 may be charged for any item not removed within the 10 business days allowed and stated on the Buyer's Certificate. Guaranty Waiver. All property is offered for sale 'AS IS, WHERE IS.' Broward County Board of County Commissioners, FL makes no warranty, guaranty or representation of any kind, expressed or implied, as to the merchantability or fitness for any purpose of the property offered for sale. Please note that upon removal of the property, all sales are final.

Description Warranty. Seller warrants to the Buyer that the property offered for sale will conform to its description. Any claim for mis-conception must be made prior to removal of the property. If Seller confirms that the property does not conform to the description, Seller will keep the property and refund any money paid. The liability of the seller shall not exceed the actual purchase price of the property.

Terms of Sale: Successful Bidder shall at all times hereafter indemnify, hold harmless and, defend the COUNTY, its officers, agents, servants, and employees from and against any and all causes of action, demands, claims, losses, liabilities and expenditures of any kind, including attorney fees, court costs, and expenses, caused or alleged to be caused by intentional or negligent act of, or omission of, Bidder, its subcontractors, employees, agents, servants, or officers, or accruing, resulting from, or related to the subject matter of this Agreement including, without limitation, the removal of any property purchased by the Bidder from the County, the sale by Bidder of any such property to third parties, any defect in the operation or physical condition of any such property and any and all claims, losses, liabilities, expenditures, demands or causes of action of any nature whatsoever resulting from injuries or damages sustained by any person or property. In the event any lawsuit or other proceeding is brought against COUNTY by reason of any such claim, cause of action or demand, Bidder shall, upon written notice from the COUNTY, resist and defend such lawsuit or proceeding by counsel satisfactory to COUNTY or, at County’s option, pay for an attorney selected by County Attorney to defend COUNTY. To the extent considered necessary by the Contract Administrator and the County Attorney, any sums due Bidder under this Agreement may be retained by COUNTY until all of COUNTY's claims for indemnification pursuant to this Agreement have been settled or otherwise resolved; and any amount withheld shall not be subject to payment of interest by COUNTY. The provisions and obligations of this section shall survive the expiration or earlier termination of this Agreement.
