All items must be removed within 7 business days from the time and date of issuance of the Buyer’s Certificate. Purchases will be released only upon receipt of payment as specified. Successful bidders are responsible for loading and removal and any and all property awarded to them from the place where the property is located as indicated on the website and in the Buyer’s Certificate. The Buyer will make all arrangements and perform all work necessary, including packing, loading and transportation of the property. Under no circumstances will Shelby County Commission assume responsibility for packing, loading or shipping. Please call in advance to schedule pick-up arrangements. Property may be removed between the hours of 8:00 am and 2:00 pm, Monday through Friday, excluding legal holidays.

All items, including vehicles, are sold “AS IS, WHERE IS”, with no warranty expressed, written, or implied. Major or minor defects may or may not be noted. Other defects may exist and it is YOUR responsibility to verify the functional ability of each item listed. Absence of any mention of defects does not mean there are none. We strongly encourage you to inspect the vehicle(s)/equipment before bidding. No further information regarding the condition of vehicle(s)/equipment will be disclosed. Maintenance records are NOT available for vehicles. Any claim for misrepresentation must be made prior to removal of the property and 5 days from close of auction. If the representative of the County determines that the claim involves substantial misrepresentation, at the representative’s discretion, the County will keep the property and return payment method to the buyer. If payment was received prior to pick-up, we cannot refund payment, only return the payment method received at the time of pick-up. Therefore, in order to claim misrepresentation after the auction closes, you must make payment in person at the time of pick-up within 5 days of issuance of buyers certificate as stated in the payment instructions. Keep in mind, we cannot guarantee that vehicle parts (such as lights and switches) will not be removed through malicious intent before the auction ends and the scheduled pick-up date. We cannot replace any missing parts. ***Please note that upon removal of the property, all sales are final! The buyer is not entitled to any payment for loss of profit or any other money damages – special, direct, indirect, or consequential. No Refunds. No Exchanges. The County will NOT provide assistance in cranking or loading vehicles. BUYER IS SOLELY RESPONSIBLE FOR ITEM INSPECTION, ITEM REMOVAL, AND SUPPLYING LABOR AND/OR EQUIPMENT NECESSARY FOR ITEM REMOVAL.
