Terms and Conditions for

Online Sales of Abandoned, Forfeited Vehicles

All bidders and other participants of this auction agree that they have read and fully understand these terms and conditions and agree to be bound thereby.


I.             Guarantee Waiver.  All property is offered for sale “AS IS, WHERE IS.”  City of Alexandria (Seller) makes no warranty, guarantee, or representation of any kind, expressed or implied, as to the merchantability or fitness for any purpose of the property offered for sale.  The Buyer is not entitled to any payment for loss of profit or any other money damages, special, direct, indirect, or consequential.


II.            Description Warranty.  Seller warrants to the Buyer that the property offered for sale will conform to its description.  Any claim for misrepresentation must be made prior to removal of the property.  If Seller confirms that the property does not conform to the description, Seller will keep the property and refund any money paid.  The liability of the City of Alexandria shall not exceed the actual purchase price of the property.  Please note that upon removal of the property, all sales are final.


III.          Abandoned Vehicle Disclosure.  Under Virginia law, the City of Alexandria (“City”) is authorized to sell abandoned vehicles at public auction.  See Virginia Code § 46.2-1203.  The City acts as the custodian of these vehicles from the time they are taken into the City’s custody until they are sold.  See Virginia Code §§ 46.2-1201 and -1202.  The City does not own these vehicles nor does the City make any representations as to their quality or condition.


IV.          Title Restrictions.




·       The City of Alexandria does not have and will not provide a title for an abandoned or forfeited vehicle.  We strongly recommend getting it titled at the local Virginia DMV when picking up the vehicle.

·       The City of Alexandria will only provide to the purchaser of an abandoned vehicle the following documents (1) Abandoned Vehicle Record Request Receipt, (2) Abandoned Vehicle Process Intent to Auction, (3) Vehicle Removal Certificate (VSA 40), (4) a Certificate of Sale and (5) Bill of Sale.

·       The purchaser may then present the abovementioned documents to the Virginia Department of Motor Vehicles (DMV) when making an application for title and attempting to register the vehicle.

·        The abovementioned documents may not be sufficient to transfer title and register the abandoned vehicle outside the Commonwealth of Virginia.  It is your responsibility to check the laws and procedures applicable in the state in which you wish to obtain title and register the vehicle. 


V.    Key Making Fee.  If you are a successful bidder for an abandoned or forfeited vehicle, a mandatory key-making fee will be added to the amount of the winning bid. 


The key making fees include:


·         Standard Key $60.00

·         Key with chip $155.00

·         Secondary Key $45.00


VI.  Personal and Property Risk.  Persons attending during exhibition, sale, or removal of goods assume all risks of damage of or loss to person and property and specifically release the seller and GovDeals from liability therefore.


VII. Inspection.  Abandoned and forfeited vehicles are used and may contain defects not immediately detectable.  Bidders may inspect the vehicles prior to bidding.

The Impound Lot is open for vehicle inspection Tuesdays and Thursdays from 10:00 a.m. to 2:00 p.m.  Call the Impounding Office at (703) 746-4664 to schedule an alternative inspection date.


VIII. Consideration of Bid.  For abandoned and forfeited vehicles, the City of Alexandria reserves the right to reject any and all bids and/or to withdraw from

sale any of the items listed.


IX.   Buyer’s Certificate.  Successful bidders will receive a Buyer’s Certificate by email from GovDeals.  Successful bidders will receive a Bill of Sale from the

City of Alexandria.  The name of the GovDeals account holder may not be changed on the Bill of Sale upon picking up the Bill of Sale from the City.


X.    Buyer’s Premium.  A twelve and a half percent (12.5%) Buyer’s Premium will be added to the final selling price of all items in addition to any taxes imposed.


XI.   Payment.  Payment in full is due not later than 3 Calendar days from the time and date of the Buyer’s Certificate.  Payment must be made electronically

through the GovDeals Website.  Acceptable forms of payment are


·         PayPal

·         Wire Transfer

·         Credit Card (Visa, MasterCard, Discover, or American Express)


      PayPal and credit card purchases are limited to below $5,000.00.  If the

winning bid amount, plus any applicable taxes and the buyer’s premium are equal to more than $4,999.99, neither PayPal nor credit cards may be used.  If Wire Transfer is the chosen method of payment, a Wire Transfer Transaction Summary page will provide payment and account information.  The Wire Transfer must be completed within five (5) days.


XII.           Escrow Payment.  When the purchase price (of a single item or the

aggregate purchase price of multiple items) totals $5,000.00 or greater, Seller may require a down payment from the winning Buyer.  This non-refundable fee will be 20% of the total purchase price.  When Seller exercises this option, Buyer will have 48-hours from the time of issuance of the Buyer’s Certificate, to comply with this requirement If Buyer fails to comply with this requirement within the stated time frame, Seller can declare Buyer in default, bar them from further bidding, and have them removed from the GovDeals system.  If Buyer is in default, Seller may negotiate with next closest bidder, re-list at another auction, and/or pursue all legal proceedings.  All monies collected in escrow, will be deducted from total monies due at time of final payment.



This vehicle must be removed within seven (7) Calendar days from the time and date of issuance of the Buyer’s Certificate. Purchases will be released only upon receipt of payment as specified.  Prior to removal, a Buyer must present documentation either by email or with the authorized representative stating they have authorized a removal on their behalf.  The Buyer or Buyer’s authorized representative must sign a Bill of Sale before removal as well.  Please contact Jordan Howar at (703) 746-3997 or email to schedule removal.  Prior to removal, all paperwork must be signed at 100 N. All property awarded to successful bidders must be loaded and removed by the bidder.  The Buyer will make all arrangements and perform all work necessary, including packing, loading, and transporting of the property.  Under no circumstances will City of Alexandria assume responsibility for packing, loading, or shipping.  This also includes arranging for a third party to pick up your vehicle.  Your authorization to use a third party must be sent to Jordan Howar prior to pickup.  This vehicle may be removed between the hours of 9:00 a.m.–1:00 p.m. and 2:00 p.m.–3:00 p.m., Monday through Friday, excluding legal holidays.   A daily storage fee of $40.00 per day will be charged for any vehicle not removed within the ten (7) calendar days allowed and as stated on the Buyer’s Certificate.


Only a successful bidder may claim a vehicle upon providing adequate identification.  A successful bidder may authorize a representative to claim and remove a vehicle on their behalf by providing documentation to Ms. Hogue, either by email or through the authorized representative.


XIV.     Default.  Default shall include (1) failure to observe these terms and conditions (2) failure to make good and timely payment or (3) failure to remove all items within the specified time. Default may result in termination of the contract and suspension from participation in all future sales until the default has been cured. If the Buyer fails in the performance of their obligations, Seller may exercise such rights and may pursue such remedies which are provided by law.  The Buyer agrees to forfeit monies paid in the case of items not removed within removal period previously stated in these Terms and Conditions.  Seller reserves the right to reclaim and resell all items defaulted.


XV.        Acceptance of Terms and Conditions.  By submitting a bid, bidder agrees that they have read, fully understand and accept these Terms and Conditions of Online Sales, and agree to pay for and remove the property, if the bid is accepted, by the dates and times specified.   These Terms and Conditions are displayed at the top of each page of each item listed on GovDeals.


XVI.      State/Local Sales and/or Use Tax.  Buyers may be subject to payment of State and/or local sales and/or use tax.  Buyers are responsible for contacting the appropriate tax office, completing any forms, and paying any taxes that may be imposed.


XVII.     Disposal.  Buyer shall dispose of property purchased from Seller in accordance with all applicable federal, state, and local laws, regulations, and ordinances.  Seller takes no responsibility for the actions of Buyer with respect to the disposal of property.


XVIII.  Sales to Employees.  Employees of the City of Alexandria may bid on the property listed for auction.  An Employee Participation Affidavit must be filled out, notarized, and returned to the Procurement Department prior to bidding.  This form may be found on AlexNet under forms for Procurement Department.  Employees may NOT bid while on duty.


XIV.       Complaints and Disputes.  Should Buyer have a complaint or dispute arising from the sale of this vehicle, Buyer shall first address the complaint or dispute in writing to Jordan Howar at Jordan Howar shall have three (3) business days to address the complaint or dispute and render her decision in writing to Buyer.  Buyer shall then have 5 days to appeal the decision.  Should Buyer decide to appeal the decision, Buyer may then contact Eleanor Foddrell for final resolution of the complaint or dispute.  All decisions made by Eleanor Foddrell shall be final and not subject to further recourse by Buyer.
