TERMS OF SALE

 

All bidders and other participants of this auction agree that they have read and fully understand these terms and agree to be bound thereby.

 

Guaranty waiver – THE SELLER MAKES NO WARRANTY, GUARANTY OR REPRESENTATION OF ANY KIND EXPRESSED OR IMPLIED AS TO THE CONDITION, UTILITY OR USABILITY OF THE PROPERTY FOR ANY PURPOSE WHATEVER OFFERED FOR SALE.  SELLER FURTHER MAKES NO WARRANTY OF MERCHANTABILITY.  NO DEDUCTION WILL BE ALLOWED ON DAMAGED ARTICLES AS ALL GOODS SOLD “AS IS” AND WITHOUT RECOURSE.

 

Buyers Premium. A 5% Buyers Premium will be added to the final selling price of all items in addition to any taxes imposed.

 

Payment. Payment in full is due not later than 5 business days from the time and date of the Buyers Certificate.  Payment must be made electronically through the GovDeals Website. Acceptable forms of payment are:

·         PayPal

·         Wire Transfer

·         Visa

·         MasterCard

·         American Express

·         Discover

PayPal and Credit Card purchases are limited to below $5,000.00. If the winning bid plus applicable taxes, if any indicated, and the buyer's premium, equals more than $4,999.99, PayPal and Credit Cards may not be used. If Wire Transfer is chosen, a Wire Transfer Transaction Summary page will provide payment and account information. The Wire Transfer must be completed within 5 days.

 

Addition to or withdrawal from sale – The County reserves the right to withdraw from sale any of the items listed or to sell at this auction items not listed.  The County also reserves the right to group one or more lots into one or more selling lots or to subdivide into two or more selling lots.

 

Inspection – Most items offered for sale are used and may contain defects not immediately detectable.  Bidders may inspect the property prior to bidding.  Bidders must adhere to the inspection dates and times indicated in the item description.  See special instructions on each auction page for details.

 

Dispute between bidders – If any dispute arises between two or more bidders, the County may decide the same or may immediately put the lot up for sale again, and resell to the highest bidder.  The decision of the County shall be final and absolute.

 

Reserve – The County reserves the right to reject any and all bids.  On lots upon which there is a reserve, the County shall have the right to bid on behalf of the seller.

 

RemovalRemoval shall be at the expense, liability, and risk of the buyer.  Buyer will make all arrangements and perform all work necessary, including packaging, loading and transportation of the property.  Property will be removed on the days listed on the buyer’s certificate only. All vehicles must be picked up from 9685 Ulmerton Road, Largo, Florida 33771.  All other items unless otherwise noted, must be picked up from 14390 Roosevelt Boulevard, Clearwater, Florida 33760.  All items/vehicles must be paid for within five (5) business days of the sale. If money is not received within five days, the item will go back on auction or offered to the next highest bidder. If items/vehicles have been paid for and have not been removed within ten business (10) days from the date of the sale, the buyer will forfeit his/her money and the item/vehicle will go back on auction or offered to the next highest bidder. Personal and property risk – Persons attending during exhibition, sale or removal of goods assume all risks of damage of or loss to person and property and specifically release the County and GovDeals.com from liability therefore.

 

Records – The record of sale kept by the County and Gov.Deals will be taken as final in the event of any dispute.
